Terms of Use

These Terms govern Plantita, operated by Clint Barbosa (“we”, “us”). Kurinto is a product brand, not a separate company. Plantita is a game where you grow plants, play short mini-games and share your garden with other players. If you do not agree, do not use the app.

Age

You must be 13 or older. The app is not directed at children and is not in the Kids category.

Your account

You can play as a guest or sign in with Apple, Google or Facebook. One person per account. You play on one device at a time: signing in on another device signs the first one out. Keep your sign-in secure. You can delete your account at any time; see Delete your account.

Player names and fair play

Choose a player name that is not offensive, does not pretend to be someone else, and does not contain personal information. Do not cheat: no modified game files, bots, automated play or exploiting bugs, and do not harass other players. We may change your name, hide you from leaderboards, or suspend or delete your account if you break these rules.

What other players see

Your player name and tag, country, portrait, score and garden are visible to other players. See the Privacy Policy.

Game items and Diamonds

Diamonds, coins, hearts, plants, flowers and other in-game items have no cash value. They cannot be exchanged for real money, sold, or moved to another account. They are a license to use inside the game, not property. Diamonds you buy do not expire. When you spend Diamonds, the item is delivered right away.

Purchases

You can buy Diamonds, bundles such as the Starter Pack, and the Plantita Club from Apple or Google. Prices are shown in the app before you buy. Payment is charged to your Apple Account or Google account when you confirm the purchase. What you buy belongs to your Plantita account: sign in to keep it on a new device.

Plantita Club

Plantita Club is an auto-renewing monthly subscription. While it is active, it gives you the daily rewards described in the app (currently four 25-minute unlimited-hearts passes and 500 coins each day; days start at 00:00 UTC, and rewards you don’t use don’t carry over to the next day). It renews automatically for the same price and length unless you turn off auto-renew at least 24 hours before the end of the current period. Renewal is charged within the 24 hours before the period ends. You can manage or cancel it in your App Store or Google Play account settings. Cancelling stops the next renewal; the Club stays active until the end of the period you paid for. Use Restore Purchases in the app to get the Club back after reinstalling.

Refunds

All purchases are final, except where the law requires otherwise. Refunds are handled only by Apple or Google, under their own rules: ask Apple at reportaproblem.apple.com, or Google through Google Play. If a purchase is refunded, we remove the Diamonds or the Club it gave you. If those Diamonds were already spent, your Diamond balance can go below zero; while it is below zero you can’t spend Diamonds, until you earn or buy more.

Online features

Saving online, leaderboards, friends and garden visits need an internet connection and may sometimes be unavailable. We may change, update or stop parts of the game.

This agreement, and Apple/Google

This is an agreement between you and Clint Barbosa, not Apple or Google. Apple and Google have no obligation to provide maintenance or support for the app. If the app fails to meet a warranty that applies to it, you may notify Apple or Google for a refund of the purchase price, if any; beyond that, Apple and Google have no other warranty obligation to you. Apple and Google are not responsible for addressing any claims relating to the app or your use of it, including product liability claims and claims that the app fails to meet a legal or regulatory requirement. Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms and may enforce them against you. You agree to comply with applicable export control and sanctions laws, and you represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

No warranty

We provide the app “as is” and “as available,” without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, title, or non-infringement, and without any promise that the app will be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent allowed by law, Clint Barbosa is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of game progress, data, or goodwill, arising out of or related to your use of, or inability to use, the app, even if we were told such damages were possible. If a court finds us liable despite the above, our total liability to you for all claims relating to the app is limited to the greater of $20 or the amount you paid us in the twelve months before the claim. Some places do not allow these limits. There, we limit liability to the maximum the law allows.

You agree to cover us if something goes wrong on your end

You agree to defend, indemnify, and hold harmless Clint Barbosa from any claim, loss, damage, or expense (including reasonable legal fees) arising from your use of the app, your violation of these Terms, or your violation of any right of another person.

Governing law

These Terms are governed by the laws of Singapore, without regard to conflict of law rules, except where your local consumer protection law requires otherwise.
